Terms & Conditions of Booking

By booking a stall with Judy’s Vintage and submitting your payment, you agree to the following terms and conditions in full. These terms are in place to ensure the safe, professional and smooth running of all events.

1. Definitions

  • The term ‘Trader’ refers to any individual, business or company booking a stall.
  • The term ‘Event’ refers to any market or event operated by The Sustainable Company (Yorkshire) Ltd.
  • The term ‘Organiser’ refers to The Sustainable Company (Yorkshire) Ltd.

2. Booking & Payment

  • Bookings are confirmed only once a completed booking form and full payment have been received.
  • Where an invoice is issued, payment is due within 14 days of the invoice date unless an alternative timeframe is expressly stated.
  • Failure to pay within the stated timeframe may result in the stall being reallocated without refund.
  • Receipts are issued via email and stored in your trader account.
  • If you do not receive booking confirmation, it is your responsibility to follow up. Non-receipt does not constitute cancellation.

3. Cancellations, Refunds & No-Shows

  • All stall bookings are non-refundable.
  • If a Trader cancels their booking, the Organiser may, at its sole discretion, attempt to re-sell the pitch.
  • If the pitch is successfully re-sold, a refund may be issued minus a £20 administration fee.
  • Refunds will only be issued once the pitch has been successfully re-sold.
  • If the pitch is not re-sold, no refund will be given.
  • Bookings are not transferable to other dates or events.
  • Traders who fail to attend will forfeit their stall fee in full and may not be invited to trade at future events.
  • The Organiser reserves the right to reallocate pitches in the event of cancellation or no-show.

4. Insurance & Legal Compliance

  • The Organiser holds Public Liability Insurance of £10 million covering the operation of the event.
  • All Traders must hold their own valid Public Liability Insurance with a minimum cover of £1 million, covering their stall, stock and trading activity.
  • Proof of insurance must be provided upon request.
  • Traders are responsible for complying with all applicable legal, safety and trading regulations.

5. Trader Status & Legal Right to Trade

  • Traders book as independent self-employed businesses.
  • Nothing in these Terms creates a contract of employment, agency, partnership or joint venture between the Trader and the Organiser.
  • Traders confirm that they are legally entitled to trade in the UK.
  • Traders are solely responsible for their own tax, National Insurance, VAT where applicable, and immigration compliance.
  • Proof of entitlement to trade may be requested at any time and must be provided upon request.
  • Failure to provide proof may result in refusal of entry or removal from the event without refund.

6. Arrival, Set-Up & Vehicle Access

  • Traders must arrive at their allocated time and follow all instructions issued by event staff.
  • Vehicles must follow designated routes and adhere to vehicle movement restrictions.
  • Failure to comply may result in delayed access, refusal of entry or removal from the event.

7. Stall Setup & Equipment

  • Pitch sizes vary depending on the event and venue.
  • Traders must ensure that all equipment, including tables, rails and display items, fits within their allocated space.
  • Traders are responsible for bringing all equipment required to trade unless otherwise specified.
  • Where gazebos are required, traders must provide their own and ensure they are securely weighted in line with event-specific safety requirements, typically a minimum of 24kg per leg unless otherwise advised.
  • Failure to comply with setup or safety requirements may result in removal from the event without refund.

8. Use of Space & Pitch Allocation

  • Traders must not exceed their allocated space.
  • Emergency access routes must be kept clear at all times.
  • Judy’s Vintage operates across a range of venues, including outdoor and street market environments.
  • Pitch locations are determined by operational, environmental and curation requirements.
  • The Organiser reserves the absolute right to allocate, reallocate and amend stall positions at any time.
  • No liability is accepted for any loss of earnings, loss of opportunity or other financial impact arising from stall positioning.

9. Health & Safety

  • Traders must comply with all health and safety requirements.
  • Instructions from event staff must be followed immediately.
  • Any unsafe behaviour may result in removal from the event without refund.

10. Electrical, Gas & Equipment Safety

  • All electrical equipment must be PAT tested where applicable.
  • Gas equipment must be safe, compliant and suitable for use.
  • The Organiser reserves the right to prohibit the use of any unsafe equipment.

11. Prohibited Items

  • Traders must not sell, display or offer any items deemed dangerous, unlawful or unsuitable for a Judy’s Vintage event.
  • Prohibited items include weapons or blades, explosives or fireworks, hazardous materials, counterfeit goods, replica goods or copyright-infringing goods.
  • Items containing ivory, tortoiseshell or materials restricted under CITES or UK wildlife legislation are not permitted.
  • Stock misrepresented as genuine vintage, including kilo-sale grade clothing, modern fast-fashion or new wholesale stock, is not permitted unless expressly agreed in writing with the Organiser.
  • The Organiser reserves the right to require the immediate removal of any unsuitable items from sale.
  • Where appropriate, the Organiser may remove the Trader from the event without refund.

12. Behaviour & Conduct

  • Traders are expected to behave professionally and respectfully at all times.
  • Rudeness, aggression or failure to follow instructions may result in removal from the event and/or a ban from future events.
  • The Organiser reserves the right to refuse future bookings at its discretion.

13. Waste, Clean-Up & Sustainability

  • Traders must remove all rubbish, packaging and belongings from site at the end of the event.
  • Any stall left in poor condition may incur a clean-up charge of a minimum of £50.
  • Additional costs may be charged at cost where specialist clearance is required.
  • Traders are expected to minimise plastic use and take all waste away from site.
  • Failure to leave the stall area in good condition may result in refusal of future bookings.

14. Photography & Promotion

  • By attending Judy’s Vintage events, Traders agree that the Organiser may photograph and film stalls, products and the general event environment.
  • This content may be used for marketing, editorial and promotional purposes across social media, websites, print and other media.
  • Where a Trader is personally identifiable in an image, the Organiser will rely on the Trader’s consent.
  • Consent may be withdrawn at any time by written request to the Organiser.
  • Traders may request the removal of specific images from active marketing channels by contacting the Organiser in writing.
  • The Organiser will action reasonable requests promptly but cannot guarantee removal from third-party platforms or previously distributed materials.

15. Food Traders

  • All food and drink traders must comply with relevant UK food safety legislation.
  • This includes registration with their local authority, maintaining hygiene standards, displaying allergen information and ensuring safe operation of all equipment.
  • Failure to comply may result in immediate removal from the event without refund.

16. Force Majeure & Event Changes

  • The Organiser shall not be liable for any cancellation, delay or change to an event caused by circumstances beyond its reasonable control.
  • This includes weather conditions, government or council restrictions, safety concerns, venue issues or similar circumstances.
  • In such circumstances, stall fees will not be refunded.
  • Transfers may be offered at the Organiser’s discretion.

17. Outdoor Events

  • Many Judy’s Vintage events take place outdoors and are subject to environmental and operational factors.
  • Layouts, timings and access may change where required.
  • By booking, Traders acknowledge and accept the flexible nature of outdoor markets.
  • The Organiser shall not be liable for any costs or losses incurred as a result of such changes.

18. Trader Suitability & Curation

  • All Traders are subject to approval.
  • The Organiser reserves the right to cancel or refuse bookings where a Trader’s product or presentation is deemed unsuitable.
  • The Organiser may also cancel or refuse bookings where a booking misrepresents the Trader’s offering.
  • Traders must clearly display their own refund policy to customers where applicable.

19. Booking Errors & Technical Issues

  • The Organiser shall not be liable for errors arising from technical issues, including website malfunctions, system errors or accidental overbooking.
  • In the event of overbooking or error, the Organiser reserves the right to cancel or amend bookings at its discretion.
  • Where a booking cannot be fulfilled, a full refund will be issued.
  • This shall be the Trader’s sole remedy, and no further compensation shall be payable.

20. Nature of Booking

  • A stall booking constitutes a licence to trade only.
  • It does not create any form of employment, partnership or guarantee of earnings or commercial success.
  • All trading outcomes are the responsibility of the Trader.

21. Limitation of Liability

  • To the fullest extent permitted by law, the Organiser shall not be liable for any indirect or consequential loss.
  • This includes, but is not limited to, loss of profits, loss of earnings, loss of opportunity or business interruption.

22. Reputation

  • Traders agree not to make false, misleading or defamatory statements about the Organiser, its staff or its events.

23. Data Protection

  • The Organiser processes Trader personal data in accordance with UK GDPR and the Data Protection Act 2018.
  • This may include name, contact details, business information and payment details.
  • Data is processed for the purposes of administering bookings, communicating about events, processing payments and complying with legal obligations.
  • Trader data will not be sold or shared with third parties except where necessary to deliver the event, or where required by law.

24. Governing Law & Jurisdiction

  • These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
  • The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from these Terms.

25. Acceptance of Terms

  • Booking and attending a stall constitutes full acceptance of these Terms & Conditions.
  • Failure to comply may result in removal from the event without refund.
  • Failure to comply may also affect future participation in Judy’s Vintage events.
